These Terms and Conditions (“Terms”) govern your access to and use of the Mini Monster Karts website and your purchase of any products from us. By using this website or placing an order, you agree to these Terms. If you do not agree, please do not use the site or place an order.
In these Terms, “we,” “us,” and “our” refer to Mini Monster Karts, and “you” refers to the person using the site or placing an order.
1. Eligibility
You must be at least 18 years old, or the age of majority in your location, to place an order or create an account. Our products are motorized ride-on vehicles intended for use under adult supervision. By purchasing, you confirm that you are buying as an adult and that any minor using the product will be supervised by a responsible adult.
2. Your Account
You may create an account on the My Account page. You are responsible for keeping your login details secure and for all activity under your account. Let us know immediately at sales@minimonsterkarts.com if you believe your account has been used without your permission. We may suspend or close accounts that violate these Terms.
3. Products, Descriptions, and Pricing
We work to describe and picture our products as accurately as possible. Many of our rides are vintage, used, or refurbished, and exact specifications may vary from unit to unit and from any general model information shown. Colors may appear differently on different screens.
All prices are listed in USD and are subject to change without notice. We reserve the right to correct any errors in pricing or product information and to cancel any order placed based on inaccurate information, even after an order has been submitted. If we cancel an order you have paid for due to such an error, we will issue a full refund.
4. Orders and Acceptance
When you place an order, you make an offer to buy. Your order is accepted only when we send confirmation that it has shipped. We reserve the right to refuse or cancel any order, including where a product is unavailable, a pricing error has occurred, or we suspect fraud.
Orders are processed within 1–2 business days.
5. Payment
Payment is due in full at checkout unless otherwise agreed in writing. We accept the payment methods shown at checkout. Payments are processed securely by our third-party payment provider; we do not store your full card details on our own systems.
6. Sales Tax
Sales tax is applied where required by law, based on your shipping address, and shown at checkout before payment.
7. Shipping and Delivery
We ship across the USA and worldwide. Shipping costs are calculated at checkout based on your address. Estimated delivery is generally 5–10 business days after processing, though larger rides shipped by freight may take longer. Delivery timeframes are estimates, not guarantees. Risk of loss passes to you upon delivery to the address you provide.
You are responsible for providing an accurate shipping address. If you enter an incorrect address, contact us immediately at sales@minimonsterkarts.com or +1 (213) 706-1490. If a package is returned to us or lost due to an incorrect address you provided, additional shipping charges may apply. International orders may be subject to import duties and taxes, which are your responsibility.
8. Cancellations and Changes
If you need to change or cancel an order, contact us as soon as possible. We can usually accommodate changes before an order ships (typically within the 1–2 business day processing window). Once an order has shipped, it cannot be cancelled, but our returns policy still applies.
9. Returns, Refunds, and Exchanges
You may return most items within 30 days of delivery, provided they are unused and in their original condition. To start a return or exchange, email sales@minimonsterkarts.com with your order number for a return authorization and instructions. Refunds are issued to your original payment method once the item is received and inspected.
10. Safe Use and Assumption of Risk
Our products are motorized vehicles that carry inherent risks. By purchasing and using them, you acknowledge and agree that:
- The product should be used only with appropriate adult supervision, protective gear (such as a helmet), and in a safe, suitable environment.
- You are responsible for reading and following all included instructions, safety guidance, and age or weight recommendations.
- You assume the risks associated with operating a motorized ride-on vehicle, including risk of injury, and are responsible for ensuring safe use by any rider.
11. Warranty
To make a claim, contact sales@minimonsterkarts.com with your order number and details of the issue.
Except as expressly stated, and to the fullest extent permitted by law, products are provided “as is,” and we disclaim other warranties not expressly given here. This does not affect any rights you have under applicable consumer protection law that cannot be excluded.
12. Limitation of Liability
To the fullest extent permitted by law, our total liability arising out of or related to any product or these Terms will not exceed the amount you paid for the product in question. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence where such limitation is prohibited.
13. Intellectual Property
All content on this website, including text, logos, and images we create, is owned by or licensed to Mini Monster Karts and may not be copied or reused without our permission. Product names and brand marks (such as licensed graphics on certain rides) are the property of their respective owners and are used for descriptive purposes only; their use does not imply any affiliation or endorsement.
14. Acceptable Use
You agree not to use the site unlawfully, to interfere with its operation, to attempt unauthorized access, or to submit false information. We may restrict or terminate access for misuse.
15. Third-Party Links
Our site may link to third-party websites. We are not responsible for their content, policies, or practices, and linking does not imply endorsement.
16. Indemnification
You agree to indemnify and hold Mini Monster Karts harmless from claims, damages, and expenses arising from your misuse of a product, your violation of these Terms, or your violation of any law or third-party right.
17. Governing Law
These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. Any dispute will be handled in the courts of California, unless applicable consumer law provides otherwise.
